Please read these Terms of Services (“Terms”), a legal agreement between The Alchemy Studio of the first part having its office at B – 86 Greater Kailash -1, New Delhi – 110048, India. (in any case, hereinafter referred to as “The Alchemy Studio.”) and users (“Users” or “You”) of the second part which shall govern use of and access to the licensed technology platform accessible through any device including but not limited to mobile phones, smart phones . By registering on, accessing, browsing, downloading or using any of the Services, You agree to be bound by these Terms, or the Terms as may be revised by The Alchemy Studio on its website from time to time without any further notice to you.
By creating an account, you agree to The Alchemy Studio Promotion Terms & Conditions. For the avoidance of doubt, it is clarified that these terms and conditions shall apply to all Services, whether offered by The Alchemy Studio or any of its affiliates. These Terms shall also include any additional or modified terms and conditions (as may be revised by The Alchemy Studio on its website www.thealchemystudio-in.com from time to time without any further notice to you) in relation to the Services or any additional or modified Services, terms and conditions in relation to any Service or any future service that may be offered by The Alchemy Studio.
If you violate these Terms, we may issue you a warning or immediately terminate your ability to use the Service. We may also terminate your ability to use the Service at any time with or without reason and notice to you, regardless of any liability on our part. Neither these Terms nor termination of your access or use will waive or adversely affect any other right or relief to which The Alchemy Studio may be entitled at law or in equity.
By becoming a registered user of The Alchemy Studio, you agree to be contacted via different communication modes including but not limited to email, SMS, and telephonic calls.
Accepting or agreeing to the Terms will constitute a legal contract (hereinafter Agreement) between you, being at least 18 years of age and an individual user of the Services or a customer or beneficiary of the Services, and The Alchemy Studio.
All the rights and liabilities and the benefits and the obligations under the mentioned Terms, shall only accrue to the benefit of The Alchemy Studio. The service provided by The Alchemy Studio, will be subject to compliance done by you in regards to the Terms. Regarding use of Website and the Service, You acknowledge and guarantee that:

7. Indemnification
You shall indemnify and hold harmless The Alchemy Studio for and against any and all claims, suits, judgment, losses, damages, cost and expenses arising (including taxes, fees, fines, penalties, interest, reasonable expenses of investigation and attorneys' fees and disbursements) as incurred (collectively "Damages") or relating to:
(i) Your use of This Website.
(ii) Your placement or transmission of any Content or other materials through This Website.
(iii) Your breach or violation of the law or of these Terms and Conditions. We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defence of such claim.

8. Jurisdiction and applicable laws
Use of the Services, functionalities of the Service and relationship between You and The Alchemy Studio are governed by these Terms, which shall be construed in accordance with, and governed by, Laws of India. All disputes relating to these Terms shall exclusively be governed by Laws of India and be adjudicated in India, with the High Court of Delhi as the court of first instance.
9. Miscellaneous
All rights not expressly granted herein are reserved. Our failure to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms and Conditions remain in full force and effect.
10. Orders and Purchases
· In the event of a User/Member wish to make a purchase, the User/Member may be required to register on the Website (if they aren’t registered already) after adding the item(s) to the shopping cart. The User/ Members shall also provide any other mandatory information required under law like Personal Account Number (PAN) and/or GST number at the time of purchase.
· Orders, are normally considered complete only after the full payment has been received by The Alchemy Studio
· To confirm the orders, a telephonic call will be made to the User/Member to confirm the orders so placed through the Website and verification question(s) will be asked by The Alchemy Studio to confirm the order(s). The order(s) will be confirmed only after the verification question is answered by the User/ Member.
· Once the purchase of item(s) is confirmed, The Alchemy Studio will :

Will place an order to the manufacture of the Jewellery and deliver it to the User/ Member.

In the event the bank rejects to honour any payment transaction made by a User/ Member towards an order, The Alchemy Studio shall have the right to refuse to ship the order to the User/Member without any liability whatsoever until the payment transaction has been approved.
11. Product Availability
The Alchemy Studio may not own any/all/part of the Jewellery listed on the Website. In such cases, The Alchemy Studio only manufactures and/or order the products listed on the Website from third party traders and merchants after the confirmation of the order by the User/Member and delivers the same. Therefore, there is a possibility that the item ordered by the User/Member might not be available at that point of time.
In the event, if the Jewellery so ordered is not available/ in stock with The Alchemy Studio, we will call the User/Member and suggest an alternate piece or send the selected product for manufacturing. In case the Member chooses a new item The Alchemy Studio shall confirm the new order.
Jewellery prices vary from one category of Jewellery to another and seller to seller where numerous factors like reputation of the sellers, brand value, design of the Jewellery etc. have an impact on the price of the Jewellery. The prices stated on the Website may be substantially higher or lower than the actual prices in the retail markets.
All pricing information available on the Website must be used as a general guideline for Jewellery prices. While this Website is designed to provide most accurate Jewellery pricing information, the information about the Jewellery does not provide an appraisal or guarantee of value, nor does it give suggestions or recommendation of any sort for buying or selling Jewellery. All pricing are subjective methods of analysis and no guarantee is made or liability assumed as to the accuracy or validity of the information provided on this Website.
Infrequently due to some technical errors, it may happen that the data may be inaccurately displayed on the Website. In such case, The Alchemy Studio reserves the right to correct any and all errors when they do occur and the Company does not honour inaccurate or erroneous prices. The prices on the Website are also subject to change without notice. For any order, the price is the prevailing price on the day the order is confirmed. 12. Product Weight Variance
The product weight mentioned on the Website for jewellery and amount, may vary upon manufacture of the individual product and stones/metal used for it. In case, the customer receives a product of lesser product weight than the value paid for (the weight and value mentioned on the Website), the Company will refund such differential amount to the Customer.
13. Product Descriptions
Some products that are sold may appear smaller or larger than their image displayed on the Website. The colour and size of the display of a product may vary depending on the type of computer monitor you use and its settings. The Alchemy Studio is not responsible for any such discrepancies.
14. Refunds and exchange
Any refunds due by The Alchemy Studio to the User/ Member is only applicable if there is a Damaged item received. Users are requested to send a picture of the damaged product at the time of receipt to confirm that damages caused have been during transit and not after. Once we have received the replacement piece, we will review the product in question and offer a refund or replacement depending on the product in question.
If for any reason you are not satisfied with your product, we invite you to review our exchange policy - in the event of an exchange, the User/Member must inform The Alchemy Studio upto 7 days from date of delivery . On made to order pieces there are no exchanges applicable. Once the payment has been processed an exchange can be initiated even before the product has not been delivered. The Pick up and re delivery charges will be born by The Alchemy Studio. The Alchemy Studio DOES NOT offer monetary refunds, only exchanges.
15. Shipping & Delivery
At the time of placing the order, the User/ Member shall state the full name of the recipient as stated in his / her (recipient’s) government approved photo identification. At the point of delivery, the recipient shall collect the product, by furnishing any one of the following government approved photo identification card:

Permanent Account Number (PAN) card; or
-
Passport.
*(Proof of residence mandatory.)
Delivery shall be made by the Company / courier agent only after the photo and name of the recipient is verified and confirmed by them. To ensure safe and secure delivery of the package the details of the government photo identification will be noted. The recipient of the package must cooperate with the courier agent by providing required and valid copies of his / her government approved photo identification with address proof.
In case the User/ Member want any other person to receive the delivery on his behalf he / she need to specify details of the same at the point of ordering. All items shall be delivered directly to the said person after they have provided proof of identification and residence. Once order has been placed, the User/ Member shall not be allowed to change the shipping address or recipient.
16. Domestic Shipping and returns
All Domestic shipping charges and other local charges shall be borne by the Company. Recipient accepting delivery should carefully examine the package delivered and shall not accept deliveries where the packaging has been tampered with. The recipient receiving the delivery also has the option to open the package and check its contents prior to accepting the delivery or signing the delivery receipt. They shall not accept deliveries, where they find that the box is empty or the contents are damaged or the contents are not in accordance to the order placed. We urge all customers to inspect the package for any damage or tamper before receiving or signing the receipt. (The Alchemy Studio takes no responsibilities of the Jewellery after it has been accepted by the recipient.)
To return the package, recipient is required to send the package back the way you received it, in its original packaging along with original tags. Recipient shall intimate the Company of such damage within 1 day by emailing us at sales@thealchemystudio.in and thereafter return the product(s) to us.
Once the Company receives the returned product (and it is accepted for return), the replacement product(s) will be processed within a few business days. Upon receiving the returned product, the item will be reviewed by our Quality Assurance Department. Please note that product(s) showing signs of wear or those that have been altered, resized (by a jeweller other than us) will not be accepted for replacement. Engraved merchandise may not be returned.
The recipient, upon signing the delivery receipt, acknowledges the receipt of the product in terms of the order placed with the Company. The Company is not liable to the Customer / recipient for any refund / replacement, under any circumstance, for any subsequent complaints with respect to such deliveries once delivery has been accepted by the Customer/ recipient.
If the recipient is not available at the time of delivery, the Company / courier agent shall try and deliver the item thrice before returning the same to The Alchemy Studio . All costs for re-shipment and handling in the case of non-delivery to the User/ Member shall be chargeable to the User/ Member.
Guarantee for delivery made by the Company is subject to terms and conditions of the courier company. Any inconsistency / errors in name or address will result in non-delivery of the product.
17. International Shipping
International shipping rates are calculated based on a number of factors including desired service level (standard/express), number of items being purchased by User/Member, the weight of the item, and the destination country/region. International shipping will be calculated during checkout by our courier company and shall be borne by the User/Member. Any local duties for Import are to be borne by the User/Member, at the time of delivery by the courier agent(s).
18. Duty and Taxes, Cess and Levies
All applicable taxes, cess and levies shall be borne by the User/Member.
The Duty (or customs tariffs) is set by the destination country customs authorities and is determined based on a combination of the country of origin or manufacturing of the products being purchased, and the classification of that merchandise in accordance with a harmonized system adopted and used by the countries that our courier services supports. Value Added Tax (VAT) /GST rates are set by the destination country. You will be able to view the guaranteed total amount of applicable duty and tax/ VAT/ GST for your order at the time of checkout while placing your order.
19. Gifting
In case your purchase is intended as a gift, we offer free gift packing, along with a gift message of your choice. Your gift will be delivered in distinctive TAS gift packing. So whether you order a gift to give to your loved ones personally, or want us to deliver it, the recipient is sure to be impressed.
To collect the physical product, the recipient will have to provide any one of the following government approved photo identification proof:

As it is a mandatory requirement as per local laws, the price of the gift (notional amount) will be mentioned on the external cover of the package. In the event the User/ Member wish to have a copy of the invoice, he / she can request The Alchemy Studio to ship an additional copy of the invoice to the required address at the time of placing the order. Any applicable tax, including any gift tax, if any, shall be borne by the User/Member.
To send a free gift message with your gift, enter that as a note while placing the order. The shipping address for the gift should be mentioned at the time of placing the order as well. Please note that, the shipping address cannot be changed once the order has been confirmed. If you did not enter the message while placing the order, you can email us at sales@thealchemystudio.in to include your personal message. Your personal message will be printed on a distinctive card and delivered along with the gift.
20. Insurance
Only transit insurance shall be provided by The Alchemy Studio and it shall be valid only up to the time of acceptance of delivery.
21. Product Pricing for on-line purchases from this Website
The Prices throughout the Website are quoted in Indian Rupees (INR). Product prices exclude GST, packing and shipping charges. These taxes, charges and/or cess shall be added to the Product prices at the time of payment processing through our online payment gateway. Our prices are subject to change without notice. We do not negotiate prices on products we offer through the Website. We use our best efforts to ensure that the information on The Website and the price of our products are displayed accurately. However, some system or typographical errors may occur. We reserve the right to correct any and all errors on This Website, including pricing errors. All products and information displayed on the Website constitute an invitation to offer. Your order for purchase constitutes your offer which shall be subject to the Terms and Conditions as listed herein. We reserve the right to accept or reject your offer in part or full.
No act or omission of The Alchemy Studio prior to the actual dispatch of the product(s) ordered will constitute acceptance of your offer. Subject to clause 11, if you have provided us with Your email address, we will notify You by email as soon as possible to confirm dispatch and therefore acceptance of the order.
Please note that the below delivery information applies only to orders placed online through the Website. We cannot ship our products to P.O. Boxes. These items will be sent /shipped to a street address.
Your obligations shall include:
1. To provide true, accurate, current and complete information about yourself at the time of registering with the Website.
2. To maintain and promptly update any change, if any, in your information, to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, incomplete, or not current then we have the right to reject your order and refuse to provide you with access to the Website.
22. Estimated Delivery Date
If the product is in stock, you can expect to receive the item within 10 working days (depending on the delivery address). This is subject to goods being in stock and full payment received. However, we shall not be liable for any delay in delivery and make best efforts to deliver you the order at the earliest. If in the unlikely event, we are unable to deliver Your order within the specified time period, we will cancel your order and informing you about the same, via mail or other provided means by you. In such cases, your payment against the cancelled order shall be refunded to you within 14 days from the date of cancellation of the order.
23. Shipping Your Return Packages
We only take returns if the product is damaged during transit/ the package has been tampered with. In case the product is damaged, we request you to get in touch with us within next 24 hours to start processing the cancellation or return/ exchange. In case you would like to exchange the product for another, you can email us at sales@thealchemystudio.in. If the price of the exchanged product is lower than the first product, The Alchemy Studio will refund the balance amount to you.
We recommend that you buy adequate insurance to cover the purchase price of the shipment. We will not assume responsibility for reimbursement or compensation if a return package is lost, stolen, or mishandled.

24. Cancellation or Non-acceptance of order
There may be certain orders that we are unable to accept and are constrained to cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some instance that may result in your ordered being cancelled or refused include limitations on quantities available on purchase, inaccuracies or errors in product or pricing information, or verification before accepting any order.
